RICHMOND, Va. (AP) – A Virginia woman is continuing her lengthy battle to deny child-visitation rights to her former lesbian partner.In a brief filed March 3 with the Virginia Court of Appeals, Lisa Miller’s attorneys argue that state law bars the enforcement of a Vermont court order awarding Janet Jenkins visitation rights for 6-year-old Isabella.Miller’s lawyer, Mathew Staver, said federal law can recognize the order, but cannot force Virginia to enforce it. Staver, dean of the law school at the conservative Christian-centered Liberty University, also said an amendment to the Virginia Constitution that took effect in 2007 bars same-sex marriage and enforcement of same-sex civil unions – an issue he said Miller’s litigation hadn’t previously introduced.Virginia and Vermont courts have ruled in Jenkins’ favor numerous times since she started fighting for visitation rights upon the dissolution of the civil union she and Miller obtained in Vermont in 2000. The U.S. Supreme Court has refused to hear Miller’s appeals.Jenkins’ lawyer, Rebecca K. Glenberg of the American Civil Liberties Union of Virginia, said that the appeal “has nothing new” and Miller can’t introduce Virginia’s marriage amendment now after failing to do so previously. She also said that previous court rulings have determined that under federal law, Virginia courts must enforce the Vermont court’s orders in this case.The Virginia Supreme Court ruled in June that a federal law aimed at preventing parents from crossing state lines to evade custody rulings requires Virginia courts to enforce Vermont’s order. The Vermont Supreme Court also ruled in Jenkins’ favor in 2006.The Virginia Court of Appeals ruled twice for Jenkins: Miller’s lawyers missed a deadline for appealing the first ruling, so they filed a second appeal on different grounds. The appellate court determined that the latter case failed to raise new issues, and the Virginia Supreme Court, the state’s highest court, agreed.In January, a Vermont judge denied Miller’s latest attempt in that state to deny visitation rights to Jenkins. Family Court Judge William Cohen also said Miller risked losing custody of her daughter if she continues to violate court orders. Cohen also rejected Jenkins’ effort to get primary custody of Isabella, but ordered that she get five-weeks’ custody in the summer.Miller gave birth to Isabella in April 2002, but later renounced homosexuality and moved back to the Winchester area with the child after the couple split. National gay-rights and conservative Christian groups continue to monitor the protracted legal battle.

Kevins Story VA (Judges Olds and Willis)
I only wish that F4J would come to Chesapeake, VA and protest to bring awareness to the discrimination against fathers taking place in its Juvenile and Domestic Relations Court.
I haven’t had overnight visits in more than a year because of a temporary sole custody order that Judge Willis in Chesapeake, VA ordered last February when my ex-wife snatched my kids up from Atlanta where we lived at the time and carried them to Virginia.
In February 2007 I filed for divorce and custody of my children in the Fulton County courts in Atlanta where we lived for 5 years before my wife took the children. That same month, Judge Willis in Chesapeake, Virginia in violation of Federal Law stole the jurisdiction away from the Georgia courts and gave custody without visitation to my wife that I was finally granted a divorce from in December of last year.
That wasn’t enough. I have 3 children. One was actually born in Georgia, and not in Virginia like my other 2 children. My wife and kids lived with me continuously from 1996 until my wife took the children and left in Feb. 2007. In 1999, even though I wasn’t separated from my wife, the Chesapeake Juvenile and Domestic Relations court issued an order for child support in the amount of $311 per month. Once again, it was the dishonorable Judge Willis that issued the order. So, the Department of Child Support Enforcement in Chesapeake, Virginia got a judgment in the amount of $33, 000 against me. They claimed I owed back child support from Feb. 2007 dating back to 1999 for the support of my oldest daughter Alexis. Well, I told them and demonstrated to them by presenting tax returns and medical bills as well as school records that Alexis, and my wife lived with me all those years. I was the only one working, and I did support my child. They levied all my bank accounts and garnished 65% of my wages. Needless to say, I became homeless in Atlanta because I couldn’t pay my bills after they illegally took money from my accounts that I didn’t even owe.
It took 6 months to get to court. The dishonorable

Here is where I am. I finally have a custody and visitation hearing, a year after my wife snatched the kids from me and left me in Chesapeake, Virginia on March 19, 2008. That is this week. I hope this judge orders that I can at least have normal scheduled and overnight visitations with my kids whom do love me very dearly as their father, still. But, I don’t have my hopes up, because I’ve been treated like nothing more than a criminal and a prisoner by this court in Chesapeake, VA thus far.
I hope someone in J4F can help me. I want to sue the Chesapeake court and the DCSE for violating my rights in the Federal Courts. I’ve investigated it, and it can be done. The jurisdiction for this matter would be in Norfolk, VA. With some support and encouragement and a little coaxing and perhaps hand-holding, I could file the papers myself as a pro-se litigant. I’d love to see the looks on Judge Willis’s and Judge Old’s faces as they stand in front of a Federal Court Judge and have to explain what the hell they were doin.

Judge Recounts Her Past

Judge Eileen A. Olds has been told that she does not look like a judge. As she entered room 133 in her stylish black dress, carrying her Christian Dior purse and sporting chunky black pearls, I thought she looked more like the fashion editor of Elle than a long-time judge. Judge Olds has been changing people's perceptions of the judiciary every day of the twelve years she has served on Chesapeake's Juvenile and Domestic Relations court.
On Oct. 24, Judge Olds spoke to students about what it is like to be a black woman on the court. Judge Olds has been ahead of her time for many years. She began attending the University of Virginia just four years after it began admitting women; she was one of six African-American students in her law school class; she was the first female judge in Chesapeake, as well as the first black judge; and she was recently elected as the fourth woman president of the American Judges Association.
Although things have changed in the courts when it comes to the perceptions of women and minorities, Judge Olds admits that the experience is still unique for women and minorities when it comes to the approach to the law. She pointed out that there are 425 judges in the district and circuit courts in Virginia and only eighty are women. Fewer than ten of these women serve in courts of record, and most sit in juvenile courts. She also added that many of her colleagues feel as though these are the more "touchy-feely courts" and are better suited to women.
Judge Olds says that many people perceive the juvenile court as "kiddie court," but there are serious issues. Judge Olds has more criminal cases than status offenses go through her court currently. Since there is no true family court in Virginia, Judge Olds sees all the cases dealing with family members. She noted that the most difficult cases in terms of emotional investment are those involving domestic relations that intersect with the maltreatment of children. Judge Olds's main goal in these cases is to keep a functioning family unit intact for the welfare of the child.
Judge Olds's final piece of wisdom was that future lawyers, judges, and politicians must maintain a stable and intact judiciary and preserve its independence. She advised that judges in general need to be able to make decision that they know are in the best interest of the litigants without fear of repercussions. Finally, she noted that judges have an obligation to provide as much legal education as possible to the public.These are my thoughts on this story
- Long time judge my ass, yes she has been on the bench for a decade however that doesn't mean she should be there.
- In a society where we want to the end race tides, it would seem that everyone who writes about her is always making sure to point out that she is black, "the first black female judge" I'm sure there was others before her. The first black female president of the AJA. It seem that she has an is still using her race to her own advantage.
- At least she as admitted the JDR courts are not of records so in fact they can do as they please. Hiding behind closed doors these judges and she often violate civil rights of these who stand before them. Making it hard to file complaints against judges when there are no records or witness to these crimes.
- She admits that women should be in these courts, if that the case then that could explain why men and fathers don't stand a chance in these courts.
- Now she claims her main goal is keep a functioning family unit, that the biggest damn lie she could every tell, since she hardly ever pays attention to case before her, then I guess family unit in her mind is mommy and kids, father are money machines and don't count.
- She is afraid of repercussion, to use the term best interest of the litigants, damn these judge are protected from repercussion since there are no records are their wrong doing and total violation of law to can't be exposed to the public since all hearing in her court are close to the public. That means no court watchers are there to record her actions. So what type of repercussions are she talking about and what are the ones she is afraid of.
